Richard Shibley is a founding partner of Shibley Righton and one of the pre-eminent counsel in Canada.
At one time or another Richard has been retained as legal counsel for many of the leading corporations in Canada. He has conducted litigation in all areas of private and public law including: municipal and planning law, real estate, construction law, labour relations and employment law, human rights law, constitutional law, education law, health law, insurance law, etc.
In forty-nine years of practice he has accumulated an impressive portfolio of cases which he has argued before all levels of the Ontario Courts, Federal Courts of Canada and the Supreme Court of Canada. He has appeared before most administrative tribunals in the Province and has been involved in many commissions and enquiries.
The following is a sample of some of some of the cases handled by Richard over the course of his career:
1. counsel to five Metro Toronto School Boards regarding the 1973 teachers’ strike, including mediation and arbitration proceedings to determine salary and benefits
2. counsel to Special Committee of the Ontario Legislature regarding Hydro Head Office inquiry in 1973
3. counsel to City of Toronto regarding the 1978-1982 Ontario Municipal Board hearings regarding Central Area Official Plan, Harbourfront Plan and Industrial Plans;
4. counsel to the City of Toronto regarding the 1991-1993 Railway Lands’ issues affecting Marathon Realty, C.N. Realty, et al.
5. counsel to the City of Toronto re: Harbourfront plans;
6. counsel to Canadian Pacific Railway regarding the Mississauga train derailment enquiry
7. counsel to Extendicare, Central Park Lodge, Bestview Nursing Home regarding negotiations for collective agreements including salary and benefits
8. represented the University of Toronto respecting an official plan, zoning and guidelines for the University for all parcels of land within the University precinct
9. represented Ms. Justine Blainey on a pro bono basis in her human rights appeal. Ms. Blainey was a 12 year old girl who was prevented from playing on a boys’ hockey team by the regulations of the Ontario Hockey Association and the Canadian Amateur Association. Section 19(2) of the Ontario Human Rights Code of Ontario expressly provided that there was no discrimination under the Code by reason of the actions of the hockey associations. Richard successfully argued in the Ontario Court of Appeal that section 19(2) of the Ontario Human Rights Code was contrary to section 15(1) of the Canadian Charter of Rights and Freedoms which resulted in section 19(2) being struck from the Code.
