James is a Partner in our Toronto office and is a senior counsel with over 25 years of legal experience and expertise. James serves as the leader of the firm’s Intellectual Property Practice Group, the Media, Arts & Entertainment Practice Group and the Insurance Practice Group.
Over the years James has developed a reputation for providing his clients with sound advice and strong representation combined with transactional and dispute resolution skills leading to exceptional results in matters relating to copyrighted works, trade-marks, designs, confidential information, media, film & television, advertising and marketing, publishing, the Internet, e-commerce, domain names, licencing, merchandising and other related commercial transactions. James is a registered Trademark Agent and is able to advise and guide his clients through all aspects of the registration process. He acts for clients who have brought actions against infringers of trademarks, patents and copyright and has also defended clients against whom infringement claims have been made.
James provides advice to individuals, small and medium size businesses, and public and private corporations in relation to the development, exploitation, enforcement, registration and protection of all forms of intellectual property rights in Canada. He works with his clients to develop sound and effective strategies for brand management, valuation, and prevention of loss from unauthorized use of his clients’ intellectual property. He also routinely advises clients on the licencing of their intellectual property rights. James is an active member of the International Trademark Association (INTA), the Intellectual Property Institute of Canada (IPIC) and the Licencing Executives Society (LES).
As a long time aficionado of film and television, James has chosen to devote a significant portion of his practice to acting for clients who are part of the Canadian film, television and new media industry. He acts for a wide range of clients throughout North America and abroad. James has served as counsel to writers, actors, directors, producers, talent agents & managers, animators, musicians, composers, distributors, broadcasters, financiers, bankers, investors and insurers. In his practice he regularly advises clients in all aspects of production, distribution, financing and related business transactions. James is an active member of the Canadian Film and Television Producers Association (CFTPA) were he sits on the CFTPA Copyright Committee, he is a member of the Academy of Canadian Film and Television, and is also a member of Women In Film and Television - Toronto (WIFT-T) where he sits on the Business Management for Media Professionals Committee. James also currently sits on the Board of Directors of Lights, Camera, Access! a not-for-profit charitable organization devoted to promoting the interests of talented, creative and innovative persons with disabilities working in the film and television industry.
At Shibley Righton LLP James leads the Insurance Practice Group which provides full litigation and alternative dispute resolution (ADR) services to individuals, corporations and insurers for all matters, including personal injury, property damage, commercial general liability, infringement of intellectual property rights, product liability, accident benefits, short-term and long-term disability benefits and worker’s compensation and health benefits. As a senior litigator James is an active member of The Advocates Society, the Arbitration and Mediation Institute of Ontario and the Ontario and Canadian Bar Associations.
James also knows the value and importance of professional development and is constantly upgrading and improving his skills in order to better serve his clients.
James was admitted to the Ontario Bar in 1982 after graduating from law school at the University of Western Ontario in 1980. Prior to that, James studied Economics and Political Science as an undergraduate, also at the University of Western Ontario.
In 1995 James was awarded his Masters in Business Administration (MBA) from the University of Toronto’s Rotman School of Management. Rotman’s MBA program is one of the world’s top-tier business management schools and was ranked in the top 20 in North America by the Financial Times. From the Rotman experience James received a solid business education and learned to find creative new ways to solve complex business problems.
In 2002 James was awarded his Masters of Law (LL.M) in Intellectual Property from Osgoode Hall Law School at York University. His specialized legal and business backgrounds enables him to bring a very unique and thoughtful perspective to current issues of concern to his clients. It also enables him to provide current and sound counsel to his clients regarding technology and intellectual property issues.
By way of alternative dispute resolution training James has obtained a Negotiation Workshop Certification from Harvard Law School, a Mediation Process Certification from Conflict Dispute Resolution Associates’ ADR programme based in Boulder, Colorado, and an Arbitration Certification from the Arbitration and Mediation Institute of Ontario.
