How does one capture "Paul Howard"? Ask the law school students recently polled by Maclean's magazine in The Maclean's Guide to Canadian Universities 2002, where Paul was named as one of the most popular professors at the University of Windsor.
Paul is primarily based out of Shibley Righton's office in Windsor, where he resides with his wife and colleague, Sheila MacKinnon, but he can be found just as often in our Toronto office. Paul's philosophical and intellectual prowess and his keen sense of humour and contagious laughter are appreciated by all. Despite his ability to view life from a positive and humourous perspective, Paul is capable of handling himself impeccably in the most difficult legal battles and the most serious of situations.
From a background in civil litigation, Paul's legal practice has developed a particular emphasis in public law matters, including Education Law, Human Rights Law, Constitutional Law, Administrative Law, Judicial Review and Employment Law matters. A pillar of the Education and Public Law Group, Paul now acts almost exclusively for school boards and has provided advice and representation in all areas of law affecting boards of education. Paul has also acted in litigation matters for the Ontario Human Rights Commission and the Ontario Ministry of Education.
Paul has a recognized expertise in human rights law. For more than a decade, Paul has acted for various school boards and other bodies in innumerable discrimination and harassment complaints filed under the Ontario Human Rights Code.
Paul is also a recognized authority on special education law. Indeed, Paul's graduate studies in law examined the law of special education from the human rights perspective. His Master's thesis, entitled The Special Education of Mentally Disabled Pupils: Full Inclusion's Use of Equality Right Arguments, was filed with the Supreme Court of Canada in the recent Eaton v. Brant County Board of Education case, was relied upon by legal counsel during argument of that case, and was specifically quoted by counsel for the Attorney General of Ontario during oral argument.
In the course of his litigation practice, Paul has appeared before all levels of the Courts in Ontario, the Federal Court of Canada and the Supreme Court of Canada. He has also appeared before various administrative tribunals, including the Human Rights Tribunal of Ontario, the Ontario Special Education Tribunal, grievance arbitration boards, the Pay Equity Hearings Tribunal, and the Ontario Municipal Board.
Apart from his busy practice, Paul is a member of the Faculty of Law at the University of Windsor. For the academic year 2000/2001, he served as a full-time Assistant Professor at Windsor Law School, and he currently remains on faculty as a Special Lecturer in Education Law, the first education law course ever to be offered at an Ontario law school.
Paul has taught the Public Law Section in the Bar Admission Course of the Law Society of Upper Canada since 1991. He has also served as the school board-appointed member of a Board of Reference established under the Education Act to inquire into the dismissal of a teacher.
Paul has been a presenter at numerous seminars and conferences held by the Professional Development Program of Osgoode Hall Law School, the Ontario Public School Boards' Association, the Special Education Operations Council of the Western Ontario Region of School Boards, the Canadian Association for the Practical Study of Law in Education, the Canadian Association of School Administrators, and the Principal's Course at York University, among others.
