The Court of Appeal for Ontario’s decision in Toronto Standard Condominium Corporation No. 2095 v. West Harbour City (I) Residences Corp. [2014] O.J. No. 4947, may well usher in a new era for purchasers of new condominium units. The decision raises questions of the conflict between consumer protection legislation and traditional common law principles such as buyer beware in such purchases.
